You will have a reference number in the format 7sgjw2 if your deposit is protected with our Insured scheme. If TDS holds your deposit it is protected using our custodial scheme and the following information will apply. You will have a reference number in the format EW if your deposit is protected with our Custodial scheme. If the other party does not agree to the request they will be given the opportunity to raise a dispute and use the Dispute Resolution Mechanism to decide how the deposit should be divided.
Repayment guide. It may take 10 days to do move out inspection and assess any proposed deductions. We had 2 months notice telling us that the landlord didn't want to renew so we left at the end of the tenancy.
I don't know the technical term for this but we just moved out with no fuss when the tenancy was due to expire. The checkout report was performed on the same day we left and doesn't list any major issues - there were a few bits of dirt which we offered to have re-cleaned by the end of tenancy cleaners we hired, but nothing substantial. We still haven't heard anything about any deductions - silence. It seems a bit much to leave us waiting for 2 weeks when the flat is absolutely fine.
That sounds like a section 21 no fault eviction, assuming it was done properly. I can't find the paperwork to confirm that it was s21 but it was perfectly amicable - we knew the tenancy was set to end on 27 September and we got a letter providing the correct amount of notice 2 months before that date. We've still not heard been told of any proposed deductions, despite a pretty much clear checkout report from 27 September and requesting our deposit on 30 September. There was some TDS guidance attached at the end of our contract, which advises to consider raising a TDS dispute if the deposit isn't returned within 10 days of requesting it.
A tenant cannot request the return of their deposit before the tenancy ends. They reckon they have 3 months to propose deductions and return the deposit. I reckon that's complete and utter BS because we wouldn't be able to raise a TDS dispute if they proposed deductions at the end of 3 months.
In any case, I think the unclear contract term has to be interpreted in light of the TDS guidance attached to the contract and that they therefore should have proposed deductions and returned the undisputed part of the deposit by now.
The deposit money is presumed ours unless she can propose deductions, but she's been sitting on it for 2 weeks without proposing to deduct a penny and all we've heard is "the landlord will get back to you in the next few days" repeatedly. The agents are being obstructive and keep telling us the TDS will be much slower than negotiating with the landlord. I'm not convinced they're right - it doesn't take 2 weeks to work out how much you want to try to deduct for a greasy kitchen extractor filter after you've declined to have it done for free.
Surely it wouldn't take the TDS 2 weeks to do that? Contractor may take days to inspect damage, prepare estimate and post to LL. A single claim to TDS can take months.. TDS will return any undisputed amount to T within approx.
Why did you not return property eg cooker to approx. Read the thread I linked to - paid for professional end of tenancy cleaning even though the flat wasn't perfectly clean when we moved in. They missed a bit so we tried to arrange a reclean as we specifically chose cleaners with a guarantee. The landlord declined because she's not comfortable letting professional cleaners in.
If the landlord thinks it's appropriate to charge us for a professional clean in this scenario then they are literally thieving scum. I had a similar scenario a few years back when I was a tenant. You don't have any such agreement obviously, so technically, there is no deadline at the moment, save for whatever is in your AST. I kicked off a dispute after a couple of weeks of no communication.
That focussed the LA and landlords mind to actually get back to me. They then proposed deductions which I then again disputed. All in all, it did take 2 months for a final resolution and for me to get my deposit back but at least I got it back! At the moment, you're in a state of limbo.
If advise one more email to the LA asking for your deposit to be returned in full within 24 hours, otherwise you'll have no choice but to kick off a dispute. Good luck. I've already said if we don't get an update we'll use TDS. I've also threatened to report the agents for turning up unannounced for viewings, to try to make them try a bit more.
